"Star of Your Family" Video Contest Official Rules

The following Contest is intended for play in the United States only, and shall only be construed and evaluated according to U.S. law. Do not enter this Contest if you are not located in the U.S. at the time of entry.

The “Star of Your Family” Contest (“Contest”) is open to all legal residents of the fifty (50) United States and the District of Columbia, who are the age of majority in his/her state of residence at the time of entry. Employees and their immediate families (parent, child, sibling or spouse) and/or household members of Ancestry.com Operations Inc., 360 W 4800 N, Provo, UT 84604 (the “Sponsor”), its respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and Contest agencies and any other persons or entities associated with this Contest (collectively, “Released Parties”) are ineligible to enter or win. By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize in contingent upon fulfilling all of the requirements set forth herein. Void where prohibited by law.

HOW TO ENTER: The Submission Period (“Submission Period”) of the Contest will begin at 12:00:01 a.m. Eastern Standard Time (“EST”) on March 7, 2012, and end at 11:59:59 p.m. EST on May 31, 2012. Facebook, Inc.'s computer is the official time-keeping device for the Contest, as interpreted by Sponsor in its sole discretion. Eligible Entrants can enter the Contest through the Facebook application described below. If a prospective Entrant is not already a member of Facebook, he/she may visit www.facebook.com and follow the links and instructions to become a member.

Once the eligible Entrant has become an active Facebook member, they have the opportunity to enter the Contest by visiting the Sponsor’s Facebook page (http://www.facebook.com/Ancestry.com?ref=ts) (the “Website”). A tab on the Website will direct participants to enter the Contest by completing the registration form and uploading a video (not to exceed 2 minutes in length) answering a question (posed by the Sponsor). Each properly completed and received Contest Entry form and applicable video to the aforementioned question (the “Entry”) will receive one (1) Entry into the Contest. Once submitted, entries cannot be deleted, canceled, or modified. Limit one (1) Entry per person per email address during the Submission Period. Any violation or attempt to violate this restriction may cause Sponsor to disqualify all of such person’s eligible entries. All entries must be received by 11:59:59 p.m. EST on May 31, 2012, in order to be eligible.

ADDITIONAL ENTRY REQUIREMENTS & RESTRICTIONS: The Entrant is responsible for all costs associated with the Entry. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to disqualify any person that submits more than maximum allowed entries. By participating in this Contest, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor which are final and binding in all matters relating to the Contest. By entering this Contest, Entrants agree that each Entry becomes the property of Sponsor and that the Sponsor may use the Entry for any proper promotional purpose. Any personally identifiable information collected during an Entrant's participation in this Contest will be collected by Sponsor and used by Sponsor, their respective affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules.

If a submitted Entry contains any material or elements that are not owned by the Entrant and/or are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who mentioned within the Entry (collectively, the “Clearances”). By submitting a completed Entry, the Entrant warrants and represents that he or she consents to the submission and use of the Entry in the Contest, and to its posting on the Internet in connection with the Contest.

Entries may not contain any of the following: i) Materials which include or constitute trademarks, trade names or copyrighted works created or owned by any person or entity other than Entrant or for which the Entrant has not obtained owner’s permission to use; ii) Materials which contain profanities, or bearing the name or likeness of any celebrity, living or dead; iii) Materials which contain visible phone numbers, website links, street addresses, e-mail addresses or license plate numbers; iv) Materials which contain behavior inappropriate for a general audience; v) Materials which contain nudity or any depiction of real or simulated sexual acts; vi) Materials which contain extensive or gratuitous violence; vii) Materials which violate anyone’s privacy rights, violate any confidentiality or employment agreement, or which are defamatory; viii) Materials which are derogatory to Sponsor, or any affiliated entity or person; ix) Materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; x) Materials in which any person identifiably appears where no appropriate written release has been obtained from such person granting all rights required herein; xi) Materials which do not comport with the Entry requirements. Entries which do not conform to these guidelines will be disqualified. Sponsor further reserves the right, in its sole and unfettered discretion, to verify at any time during the Contest that all necessary Clearances have been obtained and to disqualify and remove any Entry if it believes that the necessary Clearances have not been obtained.

WINNER DETERMINATION: At 11:59pm EST of May 31, 2012, the Submission will end. Each valid Contest Entry will be judged by a panel of judges appointed by the Sponsor (“Judges”), based on the clear relationship between the Entry and the following criteria: i) creativity of the video (50%); ii) breadth of family tree  (25%), and iii) diversity of family background (25%) (“Judging Criteria”). All Contest Entries will be scored by the Judges after the Submission Period. The Grand Prize winner of the Contest will be the Entrant with the highest score according to the Judging Criteria, in the Judges’ sole discretion. The First Prize winner of the Contest will be the Entrant with the 2^nd highest score according to the Judging Criteria, in the Judges’ sole discretion. All decisions of the Sponsor are final and binding. In the event of a tie, the Judges will reevaluate the Entries involved in the tie according to the Judging Criteria.  

GRAND PRIZES: There will be one (1) Grand Prize and one (1) First Prize awarded after the conclusion of the Contest. The Grand Prize winner, upon Alliance’s verification of eligibility, will receive an approximately 5-10 minute video about themselves similar to the ones that appear on a popular nationally-syndicated television show. The Grand Prize package has an Approximate Retail Value of $1,000. The First Prize winner to receive the following prize package: one (1) Ancestry World Deluxe Subscription (Approximate Retail Value “ARV” - $299), DNA kit (ARV - $79) and Fold3 membership (ARV - $80). The First Prize package has a total ARV of $458. No transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that the aforementioned prize is not available. ALL POTENTIAL WINNERS MAY BE SUBJECT TO FURTHER VERIFICATION BY SPONSOR, WHO’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability / Publicity Release and return it within ten (10) days of written notification by mail or prize may be forfeited and an alternate potential winner selected. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner may be selected for the prize at issue.

GENERAL: By accepting the Grand Prize or First Prize, where permitted by law, the winners grant to the Sponsor, its respective parents, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL SPONSOR, ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND CONTEST AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES.

By participating, Entrants release and agree to hold harmless the Sponsor, its respective parents, affiliates, subsidiaries, advertising and Contest agencies, dealers, distributors, suppliers, Prize provider and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Sponsor is not responsible for incorrect or inaccurate Entry information, whether caused by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error, which may occur in the processing of the Contest entries. Sponsor is not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person’s computer related to participating in the Contest. Any personally identifiable information collected during an Entrant's participation in this Contest will be collected by Sponsor and used by, its respective parents, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest and for marketing purposes as described in these Official Rules.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Contest, and randomly award the Prize from among all eligible entries received as of such date should fraud, virus, bugs or other causes beyond the Sponsor’s control corrupt the administration, fairness, proper play or security of the Contest. Sponsor reserves the right, at its sole discretion, to disqualify any individual (and all of his/her Contest entries) who tampers with the Entry process. This Contest is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the Utah. Any and all disputes will be individually resolved, without resort to class action, in the appropriate courts in the Utah exclusively, and subject to the laws of the Utah. Should there be a conflict between the laws of the Utah and any other laws, the conflict will be resolved in favor of the laws of the Utah. All federal, state and local laws and regulations apply. Winner acknowledges that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.

USE OF DATA: All information submitted by Entrants in the Contest will be treated according to Sponsor’s Privacy Policy. By participating in the Contest and providing your e-mail address, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

How to Enter: Eligible participants can enter the Sweepstakes through the Facebook application described below.  If a prospective participant is not already a member of Facebook, he/she may visit www.facebook.com and follow the links and instructions to become a member. Once the eligible participant has become an active Facebook member, they have the opportunity to enter the “Tweet to Win” Sweepstakes by visiting the Sponsor’s Facebook page (http://www.facebook.com/Ancestry.com?ref=ts) (the “Website”). A Sweepstakes tab on the Website will direct participants to enter the Promotion by completing the registration form and providing your personal Twitter handle. An Ancestry.com tweet will then populate the user’s Twitter field and ask the user to submit it for entry. Entrants may only enter the Sweepstakes providing their own personal Twitter handle and submitting the Ancestry.com tweet. Any entrant found to be using multiple accounts to enter will be disqualified. Limit one (1) entry per person per Twitter account per day throughout the Promotion Period.

All entries must be received by 11:59:59 p.m. PDT on March 31, 2012. Internet entries must be made by the entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. In the event of a dispute regarding the identity of an individual who actually submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.  "Authorized account holder" is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to show proof of being the authorized account holder.

Drawing and Notification: The Grand Prize winners will be selected from among all eligible entries received, in a random drawing conducted on or about April 10, 2012. The Grand Prize drawing will be conducted by the Administrator, an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. One Grand Prize winner will be selected from each day of the Promotion Period. Odds of winning a prize will depend on the total number of eligible entries received on the day of entry. Each Grand Prize winner will be notified by email and/or USPS mail, or other home delivery service of Sponsor’s choice.

Grand Prizes and Prize Conditions: Following the Promotion Period, thirty-one (31) Grand Prize winners will each receive Each Grand Prize winner will receive a Blue Ray DVD of The Descendants (Approximate Retail Value - $40). Limit one (1) prize per person per household.

Total Prize Pool - $1,240. All other expenses associated with the acceptance or use of the prize, not specifically mentioned herein, are the responsibility of winners, respectively. No substitution for cash or transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that the aforementioned prize is not available.  THE POTENTIAL SWEEPSTAKES WINNERS MAY BE SUBJECT TO VERIFICATION BY SPONSOR, WHO’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue.

Other Terms & Conditions: This Sweepstakes is subject to all federal, state, and local laws (if applicable). By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns shall have the right and permission to use (unless prohibited by law) the winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without further notice, permission or compensation, and 2.) Released Parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and entrant will indemnify, defend and hold Released Parties harmless from any liability, loss, injury, or damage to entrant themselves or any other person or entity, including personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including any prize activity or travel related thereto) or participation in this Sweepstakes. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose.  Sponsor reserves the right, in its sole discretion, to disqualify any entry and to modify, terminate or suspend this Sweepstakes should virus, bugs, non-authorized human intervention, action of entrants, or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, if the Sweepstakes is modified, terminated or suspended, at Sponsor’s discretion, select winners from those eligible, non-suspect entries.

Use of Data: All information submitted by Entrants in the Contest will be treated according to Sponsor’s Privacy Policy. By participating in the Contest and providing your e-mail address, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

Disputes: By entering the Sweepstakes, entrants agree that 1.) Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; 2.) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and 3.) Under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with United States law. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts of Utah, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  The value of the prizes set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed. If the actual value of any prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
